Abstract


This study examines the environmental-liabilityof oil companies, being involved in a potentially pollutingactivity, ultimately producing damages to the environment,impacting the community, creating problems forsustainability. This analysis is based on the Brazilian legalsystem, which, through a literature review, surveys theenvironmental laws and regulations pertaining to the oilindustry, analyzes the liability system and thecharacterization of Brazilian environmental damage, whichhave specific peculiarities such as the difficulty ofidentifying the causative agent, the multiplicity of causes ofcompetition, does not fit neatly in the legal framework builtso far. Thus, we see the demand for a new theoreticalconstruct about the environmental-liability industries tocharacterize the environmental damage.Index Terms ⎯ legal framework; lialibility; environmentaldamages.
