ANÁLISE JURÍDICA CRÍTICA DA LEGISLAÇÃO AMBIENTAL NO ÂMBITO DO ESTUDO DE IMPACTO AMBIENTAL (EIA)

Abstract

Environmental Impact Assessment (EIA) should
consider alternative technologies and location of project,
identify and evaluate the environmental impacts, consider
government plans and programs, identifying the
environmental impacts of development on which to base a
decision as to its environmental sustainability. It is
emphasized that the object of this paper is to highlight the
inclusion of the law variable in the EIA, which usually
presented as a simple list of legislation and nowadays the
study provides analysis highlighted the legal interpretation
by specific considerations and issues as legal instruments
and regulatory environmental requirements to the
enterprise, at the federal, state and municipal.
