SEGURANÇA PÚBLICA: A PROPOSTA DA JUSTIÇA RESTAURATIVA

Abstract

The objective of this research is to present astudy of the tertiary prevention by means of the analysis ofpractical and legal politics that promote the inserting ofinfractor and the reduction of criminal relapses social, usingthe institute of restorative justice – that is the mediation ofcriminal conflicts – as democratic instrument of conflictresolution, inclusion and social pacification. It has seen thatrestorative justice stimulates the constructive dialoguebetween victim and infractor, presenting the mediator as theassistant of this communication, making that the victimperceives the infractor as a human being, demystifying theact. It is aimed at to rescue the valuation of the humanbeing, believing its constructive and positive potentialities,instead of only detaching the punishment to be threatened,that it must exist, but does not have to be the only aimed atobjective.
